Stocks–also referred to as stockades–were a common form of punishment in Colonial America. This form of public humiliation was popular during medieval and Renaissance times as well. Aren’t we glad when our forefathers were establishing laws–and the consequences for breaking them–they removed such “cruel and unusual punishment” from the list of possibilities? The phrase was adopted by the Eighth Amendment to the United States Constitution (ratified 1791) and is part of the Bill of Rights. The United States Supreme Court has upheld that the Cruel and Unusual Punishment Clause also applies to the states. Its verbiage was derived from the English Bill of Rights of 1689.
